From 19 years of practice, I can tell you that an assault charge should never be taken lightly. Aggravated assault (serious bodily injury, use of a weapon, or vehicular assault) is a serious crime with the very real possibility of prison.
I do not simply encourage you to plead guilty. My goal is to convince the prosecutor or the court to dismiss the case, or to at least avoid incarceration. Every case has a unique set of circumstances that will determine our approach. I explore all defenses and mitigating factors, such as self-defense or aid of another, mutual combat, provocation, and conflicting statements of witnesses or the victim.
If you decide to plead guilty or are found guilty and have no violent prior offenses, I will argue for non-custodial probation which may include anger management counseling instead of a jail term.
