DUI/DWI Penalties DWI First Offense Penalties Generally, if this is your first offense, and your blood alcohol content (BAC) is .10 or higher or you were driving under the influence of drugs, you face a fine of $300 to $500, and a driver’s license suspension for 7 to 12 months. You can be sentenced to jail for a first time offense, but unless there are aggravating factors involved, you are unlikely to receive a jail sentence as a result of a first conviction. If your BAC is a .08-.099 you face a drivers license suspension of 3 months. Additionally, you will be ordered to pay $50 to the Violent Crimes Compensation Board (VCCB), $100 to the Drunk Driving Enforcement Fund (DDEF), $100 to the Alcohol Education and Rehabilitation Fund (AERF) and $75 to the Safe Neighborhoods Service Fund (SNSF). You will have to attend a program at an Intoxicated Driving Resource Center (IDRC). These programs will last anywhere from 12 to 48 hours. Lastly, you will be forced to pay a surcharge of $1000 each year for three years following a DWI conviction. DWI Second Offense Penalties For a second offense, you will be fined $500 to $1000 and your driver’s license will be suspended for two years. You will be facing anywhere from 2 to 90 days in jail, and 30 days of community service. The court may order participation in a supervised visitation program as a condition of probation. You will be ordered to pay $50 to the VCCB, $100 to the DDEF, $100 to the AERF and $75 to the SNSF. You will have to attend a program at an Intoxicated Driving Resource Center (IDRC) and pay the costs associated with the program. Additionally, the court will either revoke your registration and license plates for two years, or will order the installation of an interlock device on any vehicle you own, lease or regularly operate for 1 to 3 years after your license suspension has ended. DWI Third (and Subsequent) Offense Penalties For a third or subsequent offense, you will be fined $1000. Your driver’s license will be suspended for ten years. You will be ordered to spend at least 180 days in jail. (Although in certain situations a judge may allow you to spend up to 90 days in an inpatient rehabilitation facility approved by the IDRC program.) Additionally, you will be ordered to pay $50 to the VCCB, $100 to the DDEF, $100 to the AERF and $75 to the SNSF. You will have to attend a program at an Intoxicated Driving Resource Center (IDRC) and pay the attendant costs. Additionally, the court will either revoke your registration and license plates for ten years, or will order the installation of an interlock device on any vehicle you own, lease or regularly operate for 1 to 3 years after your license suspension has ended.
